The National Tank Truck Carriers trade
group representing bulk transporters has asked for an "indefinite
postponement" of the effective date of regulations which require
"fingerprint-based criminal background checks" for Commercial Drivers
License holders with hazmat endorsements.
Under current rules, the fingerprinting would be required as of Nov. 3. The NTTC request was contained in a filing before the Transportation Security Administration.
While noting its support for the concept of fingerprint-based background
checks, NTTC pointed out that: "Cold reality dictates that, beginning on
Nov. 3, 2003, all applicants for new (and renewals of) hazmat
endorsements must initiate the application process with fingerprints taken
'in a form and manner' proscribed by TSA. However, TSA has yet to advise
the public of the acceptable 'form and manner' of the fingerprinting.
"Likewise, TSA has yet to publish any 'chain of custody' with regard to how
fingerprint records are to be transmitted from the entity doing the
fingerprinting to the state licensing agency," NTTC added.
NTTC reminded TSA of its plan to rely on the American Association of Motor
Vehicle Administrators as a key player to implement the new
regulations. Yet, in a June 20 letter to TSA from AAMVA, that organization bolstered NTTC’s arguments by noting, "The AAMVA community has very serious concerns about the implementation timeframe of the interim final rule, particularly in light of the fact that neither the technical
specifications states need to make necessary modifications to the Commercial
Driver License Information System have been detailed, nor have
many of the other critical aspects of the credentialing and background check
procedures."
